Please read these Terms of Service (“Terms”, “Agreement”) carefully before engaging the services of SMElevateAI ("Company", "we", "us", or "our"). By using our services, you agree to be bound by these Terms.

1. Service Scope and Delivery

SMElevateAI provides tailored marketing, CRM, automation, and client management systems to micro, small, and medium-sized businesses in the United Kingdom.

Each service package is customized to meet the individual requirements of the Client (“you”, “your”). Service deliverables, pricing, and timelines will be mutually agreed upon in writing before commencement.

While we act in good faith and with professional diligence, SMElevateAI makes

no guarantees regarding specific results, business growth, or lead conversion rates.

2. Payment Terms

Payment is due on the 1st of each calendar month.If the service starts mid-month, a pro-rata payment will be calculated based on the number of days remaining in that month.Invoices will be issued electronically unless otherwise agreed. Non-payment may result in suspension or termination of services without further notice.

All prices are quoted exclusive of VAT unless stated otherwise.

3. Cancellations and Termination

You may cancel your services with us at any time by providing written notice via email.

Services will continue until the end of the current paid month.

No partial refunds will be issued for unused portions of a month already paid for.

SMElevateAI also reserves the right to suspend or terminate services if you breach these Terms or any related agreement.

4. Service Tailoring and Changes

All service packages are bespoke and built specifically around each Client’s business needs.

Accordingly, service scope, deliverables, and pricing may differ between Clients. No two packages are identical.

SMElevateAI retains the right to adjust and refine service offerings to better meet Client objectives, with prior communication and consent.

5. Price Adjustments

Unless otherwise specified in a signed client agreement, SMElevateAI reserves the right to

adjust service prices annually in line with inflation, market conditions, or changes in business operations.

Clients will be notified in writing at least 30 days before any price changes come into effect.

6. Limitation of Liability

To the maximum extent permitted by law:

SMElevateAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

Our total liability arising out of or related to these Terms shall not exceed the total amount paid by you to SMElevateAI during the three (3) months preceding the claim.

You agree to indemnify and hold harmless SMElevateAI and its affiliates from any claims, damages, liabilities, or expenses arising out of your use of our services.

7. Data Handling and Privacy

All data you provide will be processed and stored securely in accordance with our Privacy Policy.

Data is primarily hosted and managed through the GoHighLevel platform. Please refer to GoHighLevel’s Privacy Policy for further information.

You retain ownership of your data at all times. We do not sell or share your data with any third parties.

8. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of England and Wales.

Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

By engaging with SMElevateAI, you acknowledge that you have read, understood, and agreed to these Terms.
